__________________________________________________________________________________

B)Your puppy will be Vet checked by the breeders veterinarian, prior to delivery of said puppy to buyer. Buyer has 72 business hours to have the dog examined by a veterinarian of buyers choice and to personally inspect the dog / puppy, at buyers expense.  Any claims must be made within this time period and buyer must provide to seller all health records, reports, etc. from Buyers Veterinarian. Any health issues on returned animals will be subject to verification by sellers own veterinarian. If a new owner fails to take their new puppy to a veterinarian, of their choice, within 72 business hours of purchase, it will render the health guarantee null and void.  Seller does not warranty any future health concerns beyond the 72 hour health grace period,  whether they are deemed hereditary or contracted except under the terms of the Hip Warranty within this contract.

C) Buyer may return puppy to Seller for a refund based on medical issues with the animal only and only within the 72 hour health grace period or under the terms of the Hip Warranty.   If a replacement puppy from the current litter (provided an alternate puppy is available) or from a future litter,  is not chosen when requesting a return under the 72 hour grace period terms,  the refund will be less the non-refundable deposit.  Those buyers purchasing by placing an advanced deposit or payment in full, in advance,  to hold a puppy, understand that if they did not place a separate payment for the deposit,  the first $300.00(plus any option fees) of your purchase price is the amount of the deposit and the deposit rules will apply.   If you purchased your puppy outright and we did not hold a puppy for you with a payment/deposit, you will be entitled to $100% refund under the terms of the 72 hour grace period rules.  Buyer agrees to pay all transportation fees incurred, if any,  to return said puppy to JB Kennels German Shepherds.

*******Please note, we DO NOT offer any type of financial refunds for any reason after the 72 hour health grace period EXCEPT under the Hip Warranty******

Seller is not responsible for ANY future health issues. Seller is also not responsible for behavior, temperament, lack of training, neglect, abuse, teasing, failing to train the dog / puppy properly or environment after the dog / puppy leaves the JB German Shepherds property. JB German Shepherds strongly recommends the buyer take their new puppy to obedience classes to learn proper handling techniques (generally around 5-6 months of age). Most problems that arise are from lack of socialization, lack or incorrect training or lack of exercise and attention. Seller is not responsible for any expenses incurred by buyer whatsoever.

D) Buyer is completely satisfied with, and waives any and all claims regarding the dog's conformation and outward appearance. Buyer agrees the puppy is being purchased as a companion. Seller confirms that said dog / puppy is a purebred German Shepherd and Seller will provide Registration Application to Buyer through CKC _____ (Continental Kennel Club) or AKC _____ (American Kennel Club), depending on the breeding,  upon evidence from Veterinary Record, at buyers expense, that said animal has been spayed or neutered. Spay or Neuter should not be done prior to 15 months of age. There are many studies that indicate spay or neuter prior to that age is detrimental to the German Shepherd and may cause increased incidence of hip dysplasia as well as multiple increased incidents of cancers and growth abnormalties.

E) The buyer is committed to, and has accepted the responsibility of raising and owning a puppy / dog prior to this purchase. This includes, but is not limited to, training, safety, affection, diet and veterinary care.

HIP WARRANTY
All purebred dogs are predisposed to certain illnesses and health issues. This arises from the selective breeding that originally took place to produce the purebred dog. Unfortunately, all large breed dogs, including the German Shepherd are at risk for developing hip dysplasia. Hip dysplasia is a congenital malformation of the ball and socket joint of the hip. A dog may or may not become lame because of the disease, depending upon it's severity. Although there is no guarantee that a puppy will not get hip dysplasia, we are making every effort to avoid such an occurrence with proper testing of our breeding stock and selective breeding.

Genetics, proper nutrition and weight control share the role in the development and occurrence rate of dysplasia, both hip and elbow. Puppies have soft bones while they are growing.  They have growth plates in the elbows that do not seal until AFTER 6 months of age and hips up until 15 months of age, larger dogs (typically males) may not mature until 24 months of age, Therefore, your puppy should  not be expected to participate in long extended walks, runs or hikes until these plates have sealed.  Undue stress upon the joints such as continual climbing up and down stairs, running on unyielding surfaces such as concrete and asphalt and jumping in or out of vehicles, jumping over or up on things, rough play with family and other pets while your puppies bones are still soft and growing, premature spay or neutering can all contribute to environmentally caused dysplasias.   Injury, abuse, or premature stress on the joints will nullify the warranty as these causes are contributed from environment and not through breeding quality. You as a German Shepherd owner have approximately 80% influence as to if your puppy will get dysplasia as a result of how you raise that puppy!  Only 20% is a result of breeding and genetics!  All GSD puppies under 15 months of age should be kept somewhat lean in mass to allow for proper hip development to occur NATURALLY without the undue stress of excess fat. As a breeder of GSD's we acknowledge and accept that we can only do our best and to breed dogs that are clear of dysplasia.

For companion puppies, our Hip Guarantee will provide a replacement pup if your original puppy is found to have hip dysplasia and certifies moderate to severe between 24 & 26 months of age.  Breeder reserves the right to make a decision prior to 24 - 26 months of age on a case by case basis. The original puppy / dog must be returned to JB German Shepherds prior to receiving replacement.

These conditions must all be followed and met prior to the receipt of the replacement dog / puppy:
A) The dog is to be x-rayed, preferably by a veterinarian that specializes in German Shepherds.  X-rays to be taken between 24 & 26 months of age.   Earlier x-ray's may be considered however, may not be accepted as a German Shepherd has substantial growing to do prior to that time.   Please understand that if a veterinarian does not specialize in the German Shepherd and if they are not a qualified veterinary radiologist, the veterinarian can easily provide a unreliable report.  X-rays taken prior to 2 years old, could read very differently after the growth stage has been completed.   The Orthopedic Foundation for Animals (OFA) will not certify a German Shepherds Hips until after the growth period is completed at the age of 2 years old.  Earlier X-rays may not be a reliable source of diagnosis of hip dysplaysia.   Many times earlier readings by a veterinarian that does not recognize what a German Shepherds hips should look like at a young age can easily mis-diagnose only to find that once they have been re-xrayed at age 2 they were reported to have good to excellent hip ratings.  A copy of the X-rays along with the diagnostic report MUST be made available to the breeder. Breeder reserves the right to have a vet of their choice review the X-rays & Report or retake the X-rays to determine if there is any conflict with findings.  Correct positioning of the dog, per the guidelines of the OFA is required.   Xrays must be read and a report provided of the findings provided by a qualified veterinary radiologist.
B) Breeder will determine, at time of receipt of Xray report, if further evaluation will be required with a copy of an OFA evaluation.  If breeder requires an OFA certification, breeder will submit x-rays to OFA. (OFA has three separate qualified, veterinary radiologists read the x-rays).
C) Proof of spay or neuter (not prior to 15 months of age) of the dysplastic dog must be supplied to the seller prior to receipt of a replacement puppy, unless other arrangements are made, in writing by the breeder.
D) Current photo of the dog from the front and sides must be provided to the seller, contract will not cover HD caused by obesity, environmental factors, nutritional deficiencies or injury.

E) Replacement puppy will be from a litter of Breeder's Choice. All shipping costs, if any,  will be the responsibility of the Buyer. Seller retains a 18 month window to provide replacement puppy. Original puppy must be returned to our kennel by the original Buyer who is responsible for all transportation costs of returning original puppy and for the new puppy, unless breeder has made special arrangements otherwise.  Any special arrangements agreed to by breeder will be agreed to in writing only.
F) All veterinarian documents must be provided to seller.
G) If the puppy/dog has been bred, this contract is null and void and no warranty will be provided.
H) Elbow Dysplasia is NOT covered as this is most often environmentally caused by the puppy owner.  Nutrition deficiencies, rough play, injury, jumping, playing with other dogs and more are just a few causes of Elbow Dysplasia.
I) If puppy is spayed or neutered prior to 15 months of age All Warranties are null and void.
J) All vaccinations, as scheduled by breeder, and age required timeline must have been given and evidence of such vaccinations to be provided to seller prior to receipt of a replacement puppy.
k) Puppy must remain on Life's Abundance Puppy Diet until 15 months of age, then transition to Life's Abundance Large Breed All Life Stages Diet or any current or future warranty is null and void.  If breeder is to warranty a puppy, breeder must be able to eliminate nutritional deficiencies as a contributing factor to any health concerns. In recent news many people lost their dogs through name brand, contaminated dog foods coming from China.  I believe, through my extensive research,  Life's Abundance is a quality diet that will reduce the incidence of nutritional deficiencies in German Shepherds.  In addition, they have never had a recall on their diet and Life's Abundance keeps a database so they can contact all owners to notify in the event of any dog food recalls with their products.  In some cases, a puppy/dog may have allergic reactions to some diets.  If this is the case with your puppy/dog, please contact the breeder directly for some alternative diet options.  Any changes in diet for the warranty to be in effect must be approved by the breeder and in writing or any current or future warranties will be void.

The breeder will only warranty genetic hip dysplasia within the first two years. Later development of hip dysplasia is not covered as it is often environmentally produced and a result of age related arthritis.

TEETH, TESTICLES and EARS

1) Seller does not guarantee teeth, testicles or ears.  It is not uncommon for a 8 week old puppies testicles not to be descended.  If the puppies testicles do not descend at all, the cost of neuter could be significantly higher than if they were descended.  All Veterinary costs are the responsibility of the buyer. Occasionally a puppy may need some assistance with getting the ears to stand. We do not guarantee that they will stand however, if your puppies ears are not standing by 4 1/2 months, please get in touch with me and we can provide some assistance by taping the ears. If you wait beyond 4 1/2 months, your puppies ears may never stand so, DON'T wait.  It is important to keep your puppies ears clean.  We use Life's Abundance Ear Care Formula.  Please ask and we will be happy to show you how to properly clean your puppies ears.

____________         I have read the Life Saving Information regarding Early Spay & Neuter

(Buyer Initial)

YOUR PUPPY HAS BEEN WELL SOCIALIZED WITH PEOPLE, CHILDREN, ELDERLY,  SMALL AND LARGE DOGS WHILE HERE WITH US.  PLEASE ENROLL YOUR PUPPY IN OBEDIENCE TRAINING FOR A MINIMUM OF 6 WEEKS (1 CLASS PER WEEK) WITH A QUALIFIED TRAINER AND CONTINUE TO SOCIALIZE YOUR PUPPY TO OTHER DOGS TO AVOID DEVELOPMENT OF DOG AGGRESSION.   DOG AGGRESSION DEVELOPS MANY TIMES WHEN A PUPPY GROWS UP WITHOUT CONTINUED SOCIALIZATION.  IT DEVELOPS OUT OF  FEAR FROM LACK OF SOCIALIZATION AT A YOUNG AGE.  This is not too much to ask as a responsible new puppy owner.  The lifetime benefit for you and your dog will be well worth the effort.

5. SELLER RESERVES FIRST RIGHT OF REFUSAL

In the event that the Buyer can no longer keep the puppy / dog FOR ANY REASON, at any time during the puppies/dogs lifetime, the Seller must be contacted and the dog be returned to Central Coast German Shepherds.  It is the buyers responsibility for any costs affiliated with return of the puppy/dog.  If breeder does not have sufficient space to take the dog/puppy,  buyer must allow the breeder to assist and approve the new placement of your dog/puppy or breeder may place the dog/puppy into foster care until a new forever home can be found.  No money

6. LIMITATIONS OF CONTRACT

This contract applies to the original puppy only, and is not transferable to a second party. No replacement option is available if the dog has been bred, only one replacement puppy will be provided per client if deemed warranted. Buyer is responsible for any and all transportation costs to and from JB German Shepherds Kennel on original and replacement puppy. Buyer is responsible for any and all veterinary expenses incurred by buyer, for any reason. Veterinary expenses will not be JB Kennels German Shepherds responsibility.

Buyer has received a copy of this agreement and agrees that he/she understands and fully agrees to all of the terms above.
