No refunds are given for any Training Services, Special Options such as Pick of the Litter Premium, Reservation Service Fees. Central Coast German Shepherds is a small Hobby Breeder. Buyers acknowledge that we are not large commercial breeders, therefore, we offer no cash refunds whatsoever.
Many health conditions, such as, but not limited to Hip Displaysia or Bloat, also known as Gastric Dilation-volvulus (GDV) may have hereditary as well as significant environmental influences that are beyond the control of the breeder. A few of the environmental influences of Hip Displaysia are early spay or neuter (prior to maturity), injury, poor quality diet, overweight or obese dogs, too strenuous of exercise or over exercise prior to 1 year of age, running up and down stairs while a puppy is young and their bones are still soft or lack of quality exercise. Central Coast German Shepherds Guarantees that our Breeding dogs are all health screened and clear of Hip Displaysia themselves, with Hip and Elbow Certifications of Good, Better or Excellent or SV; A Normal. Seller further guarantees that our breeding dogs have also been screened for Von Willebrands Disease 1 (VWD1), Degenerative Mylopethy (DM) and Multidrug Resistance 1 (MDR1).
Central Coast German Shepherds, Seller, Guarantees, at the best of their knowledge, that the puppy is healthy and of sound temperament at the time of sale. Seller has provided a Well Puppy Exam from a licensed Veterinarian that reflects any known health conditions at time of sale. Any statements of health on the Sellers Health Exam provided prior to transfer are excluded from this warranty. Buyer agrees to have a licensed veterinarian perform an Initial Health Assessment of the Puppy within 3 business days of transfer of the Puppy, at Buyer’s expense to confirm the findings from the Sellers Veterinarian and establish patient care with their new puppy. If the licensed veterinarian determines during the Initial Health Assessments that the Puppy suffers from life-threatening conditions or is otherwise unfit for sale, the following warranty will apply: Central Coast German Shepherds will provide another dog/puppy of the same quality, age, gender and value of what the puppy was at the time of original purchase when a puppy becomes available. Buyer is required to return the original puppy/dog along with all medical records, AKC documents and authorization for Microchip & AKC transfer to Central Coast German Shepherds to obtain warranty replacement. Decisions for buyers to be able to retain the original puppy may be considered under certain circumstances at the sole discretion of Central Coast German Shepherds. Return & return expenses of the puppy/dog is the sole responsibility of the buyer. No more than 1 replacement puppy will be honored and is available to only the original purchaser and is not transferable. Buyer must notify Seller and provide Seller the contact information for the licensed veterinarian who made the determination and provide all records relating to the determination within 24 hours of the determination. Buyer understands and agrees that failure to comply with this provision voids any health guarantee provided under this Agreement or otherwise. If there are any discrepancies between Sellers Veterinarian and Buyers Veterinarian the Seller retains the option to obtain a third opinion from a veterinarian of Sellers choice.
If it is determined that a dog/puppy must be euthanized due to life threatening health conditions a necropsy must be performed by a Veterinarian of which buyer and seller both agree on before any warranty replacement will be considered.
Spay/Neuter Requirement. Buyer understands and agrees that the Dog shall be used solely as a companion pet and shall not be used for breeding. Buyer further agrees to have a licensed veterinarian spay or neuter the Dog only between the age of 18-24 months for females and 20-26 months for males. If, however, Buyer provides Seller with a licensed veterinarian’s written recommendation, prior to spay or neuter, for delaying the spaying or neutering, or the need for earlier spay or neuter for health reasons, Seller will agree to extend this requirement. Buyer understands and agrees that failure to comply with this provision voids any health guarantee provided under this Agreement or otherwise and further subjects Buyer to the Liquidated Damages provision described below.
Violations of Breeding or Spay/Neuter Requirements: Buyer expressly understands and agrees that Seller’s breeding program and its dogs are valuable assets and that Seller enjoys a reputation of producing healthy and highly desireable dogs through responsible testing and breeding practices. Buyer further expressly understands and agrees that any violation of the Spay/Neuter requirement and prohibition on breeding described above will result in damages to Seller that will be difficult if not impossible to accurately estimate, because of, among other factors, the inherent difficulties in ascertaining the unauthorized sales of dogs, calculating the loss of income to Seller, valuing the threat of harm to Seller’s dogs arising from irresponsible breeding practices, and calculating the damages to Seller’s reputation should it’s dogs be used in irresponsible or un-authorized breeding practices. Accordingly, Buyer expressly understands and agrees that any violation of the Spay/Neuter requirement and prohibition on breeding described above shall entitle seller to liquidated damages in the amount of $40,000. Buyer expressly understands and agrees that such amount is not a penalty and is reasonable in light of the factors discussed herein and other factors.
The breeder is not responsible for contagious disease or accidental death and is not responsible for any veterinary expenses whatsoever.
Central Coast German Shepherds guarantees that said puppy is purebred and registered or registerable through AKC. The breeder will provide the buyer with an AKC Limited Registration Application (no breeding rights) upon evidence of Spay/Neuter.
Central Coast German Shepherds reserves first right of ownership of the dog if the owner intends to sell, give away or transfer ownership to another at any time during the dog's life at No charge to the breeder. Purchasing and adopting a puppy or dog from us is a promise to make a lifelong commitment in all aspects for providing a forever home with the best care possible. German Shepherds bond incredibly close to their owners and transitioning to a new home can be detrimental to their health. Fostering a returned dog, rehabilitating and screening for rehoming is time consuming and expensive. NO REFUNDS WILL BE GIVEN . Our puppies are greatly discounted in price to pet homes. If the buyer should place their puppy into an alternate home at any time during the puppy's life instead of returning the puppy to Central Coast German Shepherds, the buyer will be responsible to pay Central Coast German Shepherds an additional $5,000 in damages, which would constitute the Full Retail Price of the puppy.
Diet plays a significant role in environmentally caused (non-genetic) Hip Dysplasia therefore, Seller reecommends Buyer to feed a high quality diet of Life’s Abundance Puppy until 15 months of age and Life’s Abundance All Stages beyond 15 months of age It is recommended for the health of your puppy to remain on Life’s Abundance Diet and all natural treats for the duration of your dog’s life. Many pet foods have been under investigation by the FDA with suspicion of causing DCM - Dilated Cardiomyopathy (Non-Genetic Heart Disease). Although many of those cases appear to be associated with Grain Free Diets there are reports of cases being studied with Non-Grain Free Diets as well. Life’s Abundance Diets are not one of the companies being investigated for causing DCM. Life's Abundance is a MLM company however, we offer the diet to our customers at our cost and will never ask you to sign up to become a distributor. Their products are delivered right to your doorstep and have no artificial colors, no preservatives, no fillers. There has never been a recall on this diet and they are able to notify every one of their clients immediately if there should ever be a recall.
We supplement our dogs and puppies with NuVet Plus, for immune system support and NuVet Joint to support healthy joints. The benefits of these supplements can be found on our website under the NUVET tab. Please consider continuing with these beneficial supplements. Male puppies typically have their testicles drop between 8-12 weeks of age and our Vet exam is generally done at 7-7 ½ weeks old. If the health check notes male puppy is Cryptorchid it means 1 or both testicles are undescended at the time of the breeder's health exam. Breeder does not guarantee that the testicles will drop. If the testicles do not drop the neuter could have additional costs associated with it and it may require earlier neuter for the health of your dog (refer to above information regarding early spay and neuter).
Seller guarantees do not apply with regard to the dogs bite (teeth), undescended testicles, umbilical hernia, conformation, digestive conditions, ear infections, ears not standing, problems arising from allergies, potty training, personal marital or family problems, general incompatibility, problems arising from the failure to provide routine preventative health care, vaccines, parasite and flea control or dental care, problems arising from trauma or abuse or the failure to provide adequate housing, kenneling, training or exercise to the dog, and any other problems not listed in this agreement.
Transportation: If a puppy / dog is being delivered via pet transportation services: After leaving the Sellers property the seller has no liability for the care and well-being of the puppy. Seller will not be held liable for any illness, injury, loss or death that the puppy may experience while in transporters care. Be sure to verify yourself to see if the company that you are using is insured and bonded. Buyer assumes all responsibility for transportation services.
Buyer expressly understands and agrees that all remedies described herein shall be Buyers sole and exclusive remedies with respect to Sellers Health Guarantees. Seller will not issue any refunds and shall not otherwise be responsible / liable for any problems with the dog/puppy that are not covered by the Sellers Health Guarantees described herein.
Indemnity and Release: If any action or failure to act on the part of Buyer shall result in any claim, suit, loss, damage, injury, death or liability, Buyer agrees to defend, indemnify and hold Seller harmless and to pay all of Seller’s costs and expenses, including reasonable legal fees, any amount paid in settlement and any award or judgement with respect thereto. Buyer releases Seller from any and all liability, costs or damages caused by the dog/puppy after transfer by Seller, including but not limited to damage to or destruction of property and injury to any person.
Attorneys Fees: If Seller institutes any suit or action to enforce any terms of this Agreement against the Buyer, Seller shall be entitled to recover from Buyer it’s reasonable attorneys fees and costs.
Governing Law; Opportunity to consult with counsel: The parties hereby represent and acknowledge that they have been provided with the opportunity to discuss and review the terms of this agreement with their respective attorneys before signing it and that they are freely and voluntarily signing this document in exchange for the benefits provided herein. The parties further represent and acknowledge that they have been provided a reasonable period of time of which to review the terms of this agreement.
This agreement represents the entire agreement between the parties. Seller and Buyer have made no other agreements, promises, representations or warranties, express or implied, unless specifically stated in this agreement. No alteration or amendment to the agreement shall be effective unless given in writing and signed by the parties sought to be charged or bound by the alteration of amendment.
This agreement is non-transferable and applies only to the original buyer of the puppy. The entire agreement between the parties is contained herein. In the event of a dispute, Paso Robles, California will have jurisdiction over the matter. This agreement shall be governed by and construed in accordance with the laws of California.
